When do these terms and conditions come into effect, and what is the need to view, read and understand these terms and conditions?
The terms and conditions shall be effective once agreed upon, and the user acknowledges his knowledge of these terms and conditions as soon as he registers or uses the application, and also certifies the validity of all data and information provided by the user and the permission for the application and management of the application to use the information and data in accordance with these terms and conditions of use. What conditions must be met to be able to use the wallet?
These Terms and Conditions set out the terms under which the Company will enable you to register for a Wallet Account and use a Wallet Service provided by the Company.

2. If you are a person who is prohibited from using the wallet services provided by the company or who is not allowed to make or receive any payments related to the wallet services provided by the company under the regulations in force in the Kingdom of Saudi Arabia.
How can we verify your identity and check your credit information?
We may request from you to provide us with information to verify your identity or so that we can perform anti-money laundering, credit, counterterrorism, and other necessary checks as a condition of providing Company Wallet Services to you, or we may request it before allowing you to make payments or refunds through your Wallet Account. We may also (either by ourselves or through any third party) make such inquiries as we consider necessary to verify the information you provide to us, including but not limited to checking business databases or credit reports. While taking steps to verify the identity of our users, we do not guarantee the correctness of any user's identity.
What information do we need from you to access the application? What is your responsibility towards it?
Your mobile phone number, biometric information and password you choose will be used to access the Application and for the purposes of communicating with you, and you may be asked to answer a number of security questions or select any keys or login credentials that can be used to enable access to your Wallet Services The company and the authorization of the transactions subject to these terms and conditions, and you are solely responsible to the company and to any third party, the correctness of the data and information provided by you or about you, and the responsibility to maintain the confidentiality and security of your login credentials, and you should not disclose the login credentials to third parties, and if you are exposed If any of your login credentials are hacked, you must notify us immediately of the above methods so that we can stop using your Wallet Account on the Wallet Services offered by the Company in order to avoid unauthorized transactions. You will not be liable for any financial liability for any use of your Wallet Account by an unauthorized person due to the loss or hacking of your login credentials after notifying us in accordance with applicable procedures, unless due to:
fraud or negligence on your part, or
you have not taken reasonable steps to maintain and secure your login credentials; You must notify us of the above methods if you wish to ask us to unblock your Wallet Account after resolving any issues related to securing your login credentials.
Are there situations where there are limitations to general practices when agreeing to these terms and conditions?
What can I do when using the wallet?
Can I know the information and timings of my transactions?
We will provide you with a statement of the transactions you have conducted through the Application, including details of amounts, fees, expenses, commissions, execution dates and times and reference numbers for each transaction.
All charge, payment and transfer transactions appear in your wallet account, and you can check your wallet balance and transaction histories on a regular basis. You should report any discrepancies or clarify any questions you have as soon as possible by the means specified in the above paragraph.
Are there certain categories of transactions that are prohibited?
You may not use your wallet account for any illegal or prohibited purposes such as fraud or money laundering. If you conduct or attempt to conduct any transaction in violation of these prohibitions, we reserve the right (at our absolute discretion) to:
(a) to reserve the transaction and/or
(b) closing or suspending your Wallet Account and/or
(c) Reporting the transaction to the legal authorities and/or
(d) Reserving the right of the company to take legal recourse against you and to demand appropriate compensation.
You also acknowledge that in the event of your violation of these terms and conditions and these prohibitions, you release the responsibility of the company, the application and its employees for any damage or violation resulting from this towards you or towards any third party.
Can we refuse or delay your transactions?
We may refuse to carry out any transactions, orders or any other use of the Wallet Services provided by the Company if we have reasonable grounds to suspect fraud or breach of any of the terms and conditions on your part, or any breach of applicable laws and regulations. Can I open a sub-account for my wallet?
When the Service is available, we may open a Sub-Wallet Account at your request, and you assume all responsibility for the use of the Sub-Wallet Account that we consider to be part of your Wallet Account.
Will I get a payment card for my wallet?
When you complete the procedures for creating a valid and activated wallet account, you agree to the automatic issuance of a digital payment card linked to your wallet account. You hereby agree and accept all terms and conditions of the Card and your Digital Payment Card(s) will be valid and automatically activated [in accordance with the Payment Cards Terms and Conditions]. You are free to convert the digital card into a plastic card through the application, and the digital card will remain valid and activated, and you are free to activate your plastic payment card to use it.
Are there specific conditions for charging my wallet balance?
In cases where you want to top up your wallet account balance or receive any payments, it:Amounts paid by you, or any other party are credited to your Wallet Account on the business day on which they are received. If we receive funds after the cut-off time on any day (whether it is a business or non-business day), we will consider the funds to have arrived on the next business day, and we will not be liable for the funds until after they are received.
In the event that the funds relate to a canceled transaction, we will deduct the canceled transaction from the balance of your wallet account, and in the event that there are insufficient funds in the balance of your wallet account, we reserve the right to demand payment from you, and take all possible measures, including suspending your account and returning to you legally and judicially with your costs statutory and judicial if any, and you must match incoming payments with your records on a regular basis. And you should know that crediting the funds in your wallet account does not mean that those transactions cannot be cancelled.
We reserve the right to cancel any payment if the person, bank, or payment service provider that paid it has canceled (or is reasonably likely to cancel) the payment from your Wallet Account, and all payments to us must be marked with a clear and complete indication, so that we Those payments are credited to your wallet account. It is your responsibility to use accurate, complete, and correct references assigned to each incoming payment you make to your Wallet Account, so that we can credit such payments to your Wallet Account. If there is no reference or an incorrect reference is provided, we will not be able to credit the amounts to your Wallet Account. In such cases, we will not be liable for any loss you incur, although we will do everything in our power to investigate such payments and credit or return all payments not properly cross-referenced to or from your account.
We will provide you with the following information after any payment is credited to an account:
(a) a reference to enable you to identify the Payment Transaction and where this is made available to the Payer and any information transferred with the Payment Transaction; And
(b) the amount of the Payment Transaction and the currency in which the funds will be available to you; And
(c) the amount of fees or charges payable by you in connection with the Payment Transaction; And
(d) the exchange rate used by us in the Payment Transaction; And
(e) the date the Payment Transaction was credited to your Account
Are there specific conditions for sending payments to my wallet?
Choosing or sending any payment to your Wallet Account results in the following:By agreeing to carry out any payment transaction, you authorize us to carry out that transaction. You agree to make any payments by following the on-screen commands when using the Application Sending Payments from Your Wallet Account means either making payments from your Wallet Account to a third party beneficiary or instructing to transfer funds from your Wallet Account to another account in your name with a third party, or withdrawing Cash, and payment instructions must be sent to the application only. You are solely responsible for the correctness, completeness and accuracy of the instructions you give us through the Application regarding the beneficiary of the payment (including payments sent to you).
In the event that the beneficiary data you provided to us is incorrect, we will not be liable for any loss you may suffer, although we will do everything in our power to assist you in recovering your payments, and we reserve the right to charge you a fee to cover any expenses or costs we may incur during this, if We are unable to recover funds on your behalf. Upon receipt of your written request, we will provide you with all available relevant information in order to attempt to claim payment of such funds at no additional cost, and you must provide us with all additional information we require from you in connection with any payment within two business days from the date request, and you hereby consent to us including your full name, address and account number (and all other data necessary to enable us to comply with our anti-money laundering procedures) in the payment data to be sent to the beneficiary's bank or payment service provider.
You may cancel payment instructions relating to any future payments issued at any time before the payment is executed through the Application, and you are responsible for ensuring that we receive and carry out payment instructions through the Application, and we are not responsible for any loss where we receive duplicate payment instructions in error, If the Company receives payment instructions by the cut-off time on any business day, such instructions will be considered received on the same business day, but if the instructions are received after the cut-off time or on a day other than a business day, those instructions will be considered received on the next business day.
After receiving your payment instructions, we will provide you with the following:
(a) the date of success or failure of directing and executing the payment instruction and
(b) a reference number for tracking the status of payment instructions; And
(c) the amount of the Payment Instruction and any fees or charges relating thereto including the actual currency and exchange rates used, and withdrawal fees, as applicable; And
(d) the date on which we received the payment instructions. We will ensure that all payment instructions we send to you or external beneficiaries in accordance with your instructions are accompanied by the information requested as directed by the Central Bank.
What should I do when payments are made without my permission?
When you become aware of any payments that were made without your permission or were made incorrectly, you must inform us of this as soon as possible, and in order for you to claim a refund of any payment made in your wallet account without your authorization or incorrectly, you must inform us in writing without any delay and immediately If you do not inform us immediately, the Company will not be liable for any incorrect payment made, but we will use our best efforts to recover the funds from the incorrect recipient of the funds and the payment service provider dealing with the recipient.
Are there conditions to benefit from the Tweeq wallet services?
For you to benefit from the wallet services provided by the company, you must first complete the registration data for our system and open a wallet account with us. There may be restrictions on your use of the Wallet Services provided by the Company.
All information you provide during the registration process shall be valid, complete, accurate, correct and regular, and you are solely responsible for this, and you shall update the registration information immediately upon any changes to it so that it remains complete and accurate at all times, and you hereby immediately agree to provide all information or documents that we request from you ( For example, to verify your identity) or that the applicable laws and regulations or instructions issued by the Central Bank and other relevant authorities in the Kingdom of Saudi Arabia require to be provided to provide the wallet services provided by the company. You shall comply with all technical and operational specifications that we provide or make available to you in connection with the Wallet Services offered by the Company (“Specifications”). We will give you thirty (30) days' advance notice of any changes to the specifications and the terms of the paragraph below will apply.
We may make modifications or updates to the Wallet Account Services provided by the Company and/or our Materials and will notify you of any such modifications, updates or upgrades (as applicable) no less than thirty (30) days prior to their application, and the terms of the clause below shall apply; In such cases, you should test the Application or the Service and modify it as necessary to ensure that it operates in the correct manner and according to the version of the Wallet Services provided by the Company in effect at the time.
To benefit from the wallet services provided by the company, you must own a qualified device. You may request a list of eligible devices by contacting us using one of the methods set out in these Terms and Conditions. Devices that are unlocked or have their specifications changed in irregular ways are not eligible to use the Wallet Services provided by the Company.
If you wish to file a complaint about the wallet services provided by the company, you can do so by informing our customer support team in accordance with these terms and conditions, and we confirm our keenness to deal with all complaints in a fair and timely manner, and we will communicate with you regarding your complaint within a period of seven (7) calendar days from the date it was received (unless you notify us that the complaint has been resolved). We will respond to you with the decision taken in relation to your complaint within fourteen (14) calendar days from the date we receive your complaint.
Are there fees applicable to use the wallet?
You agree to pay all applicable fees each time you use the Wallet Services provided by the Company, and we will inform you of the applicable fees described in the Application from time to time, but before you authorize a payment transaction, and we reserve the right to change our fees at any time.
Fees are estimated according to the value of the transactions, including all applicable fees (such as shipping charges, taxes, etc.), and all electronic funds, fees, wages and payments collected or paid through the wallet services provided by the company are evaluated in riyals. All changes to fees will be notified to you by the Company via email or application as determined by the Company in its absolute discretion and in accordance with the terms of the clause below by providing not less than thirty (30) days' prior notice.
To the extent permitted by law, if there are any overdue amounts owed to us, you hereby authorize us to automatically deduct from your Wallet Account the overdue amount for any fees or other money owed by you to us under these Terms and Conditions and in the event that the amount owed to us exceeds the balance of your Wallet Account, we may deduct from your charging device or you may pay the amount in arrears in full upon receipt of an invoice from us for such amounts. You will be responsible for paying the invoice that we issue to you, and in the event of an error in executing any transaction, you authorize us to open debit or credit entries in your wallet account to correct that error, provided that the errors are corrected in accordance with the applicable laws and regulations.
Is there a specific period for the validity of these terms and conditions, and can I terminate it?
The provisions of these terms and conditions shall begin in accordance with the conditions set forth above, and shall remain in effect until terminated in accordance with the provisions contained in these terms and conditions, and these terms and conditions may not be terminated or modified except by the company, and in the event of closing your wallet account - according to the methods of cancellation or closure approved in the application - These terms and conditions will remain in effect to the extent necessary to apply to your closed account, and upon closing the account, all transactions in progress will be canceled.
We reserve the right to refuse to provide the Wallet Services provided by the Company or to discontinue such services to any person or entity at any time and for any reason, and we may terminate the Wallet Services for any reason and at any time and notify you of that, without limiting the foregoing.
How can you make sure your data is protected?
We will implement and maintain appropriate policies, procedures, and controls as well as conduct employee awareness training programs to protect your personal data and identify and act to prevent and resolve any data security breaches.
Who owns the intellectual property rights contained in the application?
The Application and the Platform contain copyrighted materials, names, trademarks, and other materials including but not limited to: text, software, applications, images, graphics, names or logos ("Content") which is the entire property of Tweeq Company and is protected by Intellectual property and other related regulations in force in the Kingdom of Saudi Arabia, and the company owns all copyrights and other intellectual property rights for this platform and for the published content, and you may not use, modify, copy, distribute or reproduce any of them or any of the services In the event of your violation of this, you are obligated to compensate the company for the resulting damages, while the company retains its full right to have legal and judicial recourse against you.
You hold the Company harmless for any intellectual property rights that you enter into the Application, import, or provide the Application with, and the Company also disclaims any intellectual property rights related to any third methods that may appear in the Application.
Are there warranties for these terms and conditions?
You represent and warrant that you have full power and authority to read, understand and agree to these Terms and Conditions. You promise us the following:You are eligible to register for and use the wallet services provided by the company and that you have the right, authority, legal capacity and ability to read, understand and implement these terms and conditions.
The name you specified when you registered is your real name officially registered according to your national identity card or passport.
Any purchase transaction you provide will constitute a good faith transaction by you as set out in the Application.
You may use the Wallet Services provided by the Company only for transactions relating to your account only and not on behalf of any other natural or legal person.
You and all transactions you make will comply with all laws, regulations and rules applicable to your business, including zakat, tax and customs rules and regulations.
You will not use the Wallet Services provided by the Company, whether directly or indirectly, in any fraudulent act or in any way that disrupts the use of the Wallet Services provided by the Company.
You are not subject to any sanctions and are not on any list of prohibited or restricted parties and you are not owned or controlled by any such party
We do not make any express statements or guarantees regarding the provision of the Wallet Services provided by the Company, nor do we make any representation or undertaking that the Wallet Services provided by the Company will meet all your needs, nor does it guarantee that the Services will continue uninterrupted or free from viruses, errors, security holes, or accuracy any information you obtain as a result of your use of the services or the reliability of the services terms, warranties or other terms (including implied provisions of acceptance of quality, fitness for purpose, or configuration of description) shall applicable to the website services offered by the company except to the extent expressly stated in these terms and conditions.
Do I take any responsibility for these terms and conditions?
How can you compensate insured persons?
You will indemnify and hold the Company harmless from all third-party claims against any of the Guaranteed Persons and against all liabilities, losses, and expenses (including compensation provisions, arbitration provisions, settlement amounts and reasonable legal fees) incurred or incurred by the Guaranteed Persons as a result of any matter arising out of or relating to the follows:1. any actual or alleged breach of your representations, warranties or obligations in these Terms and Conditions including without limitation any breach of our policies;2. any real or alleged infringement, depredation or violation of third party rights, applicable law (including intellectual property rights) or applicable law;3. any transaction provided by you through the Wallet Services offered by the Company;4. any negligence on your part, strict liability or willful misconduct; or5. Are there geographical limits for using the application outside the Kingdom of Saudi Arabia?
The company or the application does not guarantee that the content provided in the application is appropriate to be presented outside the borders of the Kingdom of Saudi Arabia, and access to the content provided may be illegal or contrary to the law in some countries.
During your use of the application, you undertake to comply with and apply the laws of the country in which it is located, and if you access the content from a country other than the Kingdom of Saudi Arabia, you bear all damages or losses resulting from the possibility of illegal content in that country.
